PicABook — Terms and Conditions

1. Agreement

These Terms & Conditions ("Terms") are a binding agreement between you and Sprrrint Nextgen Global Solutions LLP ("PicABook", "we", "us"), governing your use of the PicABook application and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If we make material changes to these Terms, we will notify you in the app or by email at least 15 days before they take effect. Continued use after that date constitutes acceptance; if you do not agree, stop using the Service and, if you have an active subscription, you may cancel it as described in Section 5.

2. Eligibility

You must be at least 13 years old to use the Service, and at least the age required in your country to consent to the processing of your personal data (18 in India) unless a parent or legal guardian has validly consented on your behalf where the law allows. By using the Service you represent that you meet these requirements.

3. The Service

PicABook lets you capture daily photos, organize them into albums stored in your account's cloud space, and generate videos from them. Some features — currently including Face ID album lock, unlimited albums, watermark-free export, and premium app icons — are part of the paid PLUS subscription and may change over time.

We may update, add or remove features, and may suspend the Service for maintenance. We aim to give notice of material changes to paid features; if we permanently remove a material paid feature, Section 5.4 applies.

4. Your content

4.1 You own your photos — You retain all rights in the photos and videos you create with or upload to the Service ("Your Content"). We claim no ownership of Your Content.

4.2 The license you give us — You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display Your Content back to you, solely as needed to operate and provide the Service to you. This license ends when you delete the relevant content or your account, except for residual encrypted backup copies deleted on a rolling basis within 30 days, and records we must retain by law.

4.3 What we will not do — We will not sell Your Content, use it for advertising, share it publicly, or use it to train AI or machine-learning models.

4.4 Your responsibilities — You are responsible for Your Content. You represent that you have the necessary rights to it and that it does not violate law or the rights of others. Do not upload content depicting any person other than yourself without their permission, and never upload unlawful content, including any sexual content involving minors, which we will report and remove.

5. PLUS subscription

5.1 Billing through Apple — PLUS is an auto-renewing subscription (monthly or annual) purchased through your Apple App Store account. Prices are shown in the app before you buy and may vary by region. Payment is charged to your Apple ID at confirmation of purchase.

5.2 Auto-renewal and cancellation — Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can cancel anytime in your device settings (Settings → Apple ID → Subscriptions). Cancelling stops future renewals; you keep PLUS access until the end of the paid period.

5.3 Free trials — If a free trial is offered, its length and the price after it ends are shown before you subscribe. Unused trial time is forfeited when you purchase a subscription.

5.4 Refunds — Purchases are processed by Apple, and refunds are handled by Apple under its terms — you can request one at reportaproblem.apple.com. We cannot issue App Store refunds directly. If we permanently discontinue the Service or remove a material PLUS feature during your paid period, we will direct you to Apple's refund process and support your request for a pro-rata refund.

5.5 Price changes — If prices change, the change applies from your next renewal, and Apple will notify you in advance as required; where consent is required for the new price, your subscription will not renew at the new price without it.

6. Acceptable use

You agree not to: (a) use the Service unlawfully or to infringe others' rights, including privacy and publicity rights; (b) probe, breach or circumvent security or authentication measures, or access accounts or data that are not yours; (c) reverse engineer, decompile or extract source code from the Service except where the law permits; (d) interfere with the Service, including by malware, scraping, or excessive automated requests; (e) resell or provide the Service to third parties as a service bureau; or (f) misuse the video features to create deceptive media of another person.

7. AI-processed images

Videos are generated from your photos for your personal use; you are responsible for how you share them and for any representations you make about them.

8. Intellectual property

The Service — including its software, design, graphics, logos and trademarks, but excluding Your Content — is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices you own or control, in accordance with these Terms and the App Store Terms of Service. All rights not expressly granted are reserved.

If you send us feedback or feature requests, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

9. Termination

You may stop using the Service at any time and may delete your account in the app (Profile → Settings → Delete account). We may suspend or terminate your access if you materially breach these Terms, if required by law, or if providing the Service becomes impracticable; where reasonable, we will give you prior notice and a chance to export Your Content. Sections that by their nature should survive termination (including 4.2's wind-down, 8, 10, 11, 12 and 13) survive.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that content will never be lost — keep your own copies of photos that matter to you.

PicABook is a photo-journaling tool. It does not provide medical, health, fitness or nutrition advice, and progress videos are visual records only. Consult a qualified professional before making health decisions.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data or goodwill. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim arose and (b) US $50. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or willful misconduct, or affects statutory consumer rights that cannot be waived.

12. Indemnity

To the extent permitted by law, you will indemnify and hold us harmless from third-party claims, and reasonable costs including attorneys' fees, arising from Your Content or your breach of these Terms, except to the extent caused by our own breach or misconduct.

13. Governing law and disputes

These Terms are governed by the laws of India, and the courts at Mumbai, Maharashtra have exclusive jurisdiction, except that if you are a consumer in a jurisdiction whose law grants you mandatory protections or a home-court right, those protections and venue rights are unaffected. Before filing a claim, both parties agree to try in good faith to resolve the dispute by contacting the other (for us: info@sprrrint.com) and allowing 30 days for resolution.

14. General

These Terms and the Privacy Policy are the entire agreement between us regarding the Service. If a provision is found unenforceable, the remainder stays in effect and the provision is replaced with an enforceable one reflecting its intent. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor in interest, with notice to you. Apple is not responsible for the Service and, as a third-party beneficiary of this license section, may enforce it; maintenance, support, warranty and claims are our responsibility, not Apple's.
